Case Background
According to an announcement issued by Shanghai Customs on October 15, 2024, a trading company declared the import of cutting oil (containing triethanolamine) under general trade on June 28, 2022, with the commodity code 3403990000 and a declared C&F total value of 60,040 euros. According to the Catalog of Dual-Use Items and Technologies Subject to Import License Management (Announcement No. 48 of 2021 by the Ministry of Commerce and the General Administration of Customs), an import license for dual-use items and technologies is required for the import of such goods.import and exportViolation
Customs investigation confirmed that the party failed to submit the required import license for dual-use items and technologies when importing the cutting oil. In accordance with Article 14, Paragraph 1 of the Implementation Regulations of the Customs of the Peoples Republic of China on Administrative Penalties and Article 12, Item 2 of the Customs Administrative Penalty Discretion Benchmark (I) (Announcement No. 182 of 2023 by the General Administration of Customs), Customs decided to impose a fine of RMB 27,000 on the party.
