On June 21, 2024, the United States International Trade Commission (ITC) voted to make final determinations on anti-dumping injury to the domestic industry concerning paper shopping bags imported from Cambodia, Mainland China, Colombia, India, Malaysia, Portugal, Vietnam, and Taiwan, China, and countervailing injury determinations concerning imports from Mainland China and India. The investigation began on June 21, 2023, when the U.S. Department of Commerce announced anti-dumping and countervailing duty investigations on paper shopping bags imported from Mainland China and India, and anti-dumping investigations on paper shopping bags imported from Cambodia, Colombia, Malaysia, Portugal, Turkey, Vietnam, and Taiwan region of China. On March 18, 2024, the U.S. Department of Commerce made a final anti-dumping determination on paper shopping bags imported from Turkey. Subsequently, on May 20, 2024, the U.S. Department of Commerce announced final anti-dumping determinations on paper shopping bags imported from the other seven countries and Taiwan region of China, and final countervailing duty determinations on paper shopping bags imported from Mainland China and India.
The ITC also made negative final determinations on critical circumstances for the products involved imported from Cambodia, Mainland China, India, Vietnam, and Taiwan region of China, which means that anti-dumping and countervailing duties will not be imposed retroactively on these products. This determination is mainly based on the application of the critical circumstances provision, deciding not to impose retroactive duties on products imported before the determination.
The products involved in this determination are classified under U.S. Harmonized Tariff Schedule (HTS) codes 4819.30.0040 and 4819.40.0040. Products under these codes include various types of paper shopping bags, widely used in retail and service industries.
